The following Terms of Use apply to use of the “Chefslist” platform provided and operated by Chefslist (collectively: “Chefslist App” or “App”). The terms of use apply both to access to the app via a web browser and to access via the Chefslist application on mobile devices.

You agree to the validity of these Terms of Use if you create a Chefslist user account in accordance with section 2. The terms of use then become part of your contract of use with Chefslist.

Agreements deviating from these conditions only come about if Chefslist expressly agrees to a deviation. Chefslist points out that if Chefslist does not object, deviating agreements (especially general terms and conditions) will not apply.

Funktionen der App

The Chefslist application for mobile devices can be downloaded and installed free of charge. Access to the app is also possible via web browser.

The app offers two different types of user accounts:

‍

1. User account for catering businesses such as restaurants, canteen kitchens, cafés (hereinafter summarized as: "Customer")
2. User account for suppliers

‍

The range of functions of supplier accounts is primarily determined by separate contractual agreements with the respective suppliers. These terms of use also apply to legal relationships between Chefslist and suppliers. The range of functions of customer accounts is described below:

• Customers can register in the app
• Customers can create a user profile with the following information: email address, surname, first name, company name, address, password, customer number.

‍

The presentation and functionality of a supplier website can vary and is determined by the scope of use that the respective supplier has activated in his user account. Basically, Chefslist offers the following functions:

‍

• List of the supplier's assortment, stating prices, delivery availability, number of items, container size
• Product images (customer-specific) order templates of the respective supplier
• Forwarding of the order by email or interface to the supplier
• Forwarding of the order confirmation by the supplier to the customer

‍

Chefslist endeavors to operate the app in a functional manner. Chefslist does not owe a continuous accessibility of the app or individual functions or the completeness and correctness of the information displayed.

Orders via the App

The customer can order goods from the supplier via the app.

‍

Kaufvertragsabschluss zwischen Abnehmer und Lieferant

‍

Upon receipt of the order from the supplier, the customer submits a binding offer to conclude a purchase contract. The provision of general terms and conditions (GTC) by the customer is not possible.

‍

The supplier sends the customer an order confirmation by e-mail immediately after receipt of the offer. The supplier can use Chefslist for this purpose. The purchase contract between the customer and the supplier comes into effect when the customer receives the order confirmation. It is not possible for the supplier to provide general terms and conditions.

‍

The customer is obliged to check his e-mail inbox for receipt of the order confirmation. Chefslist points out that buyers and suppliers are particularly required to check their e-mail spam filters and make adjustments if necessary so that e-mails sent by Chefslist are not blocked by spam filters.

‍

Chefslist is the technical provider of the app and not a party to the purchase contract.

‍

The supplier informs the customer of the credit account (IBAN) with the invoice. The payment of the purchase price by the customer must be made in favor of the credit account.

‍

Conclusion of a purchase contract between the customer and the supplier

‍

Der Abnehmer gibt mit Zugang der Bestellung beim Lieferanten ein verbindliches Angebot auf Abschluss eines Kaufvertrages ab. Die Stellung von Allgemeinen Geschäftsbedingungen (AGB) durch den Abnehmer ist nicht möglich.Der Lieferant übermittelt dem Abnehmer unverzüglich nach Zugang des Angebots eine Bestellbestätigung per E-Mail.

Der Lieferant kann sich hierzu Chefslist bedienen. Mit Zugang der Bestellbestätigung beim Abnehmer kommt der Kaufvertrag zwischen dem Abnehmer und dem Lieferanten zustande. Die Stellung von Allgemeinen Geschäftsbedingungen (AGB) durch den Lieferanten ist nicht möglich.

Der Abnehmer ist verpflichtet, seinen E-Mailposteingang auf Zugang der Bestellbestätigung zu überprüfen. Chefslist weist daraufhin, dass Abnehmer und Lieferanten insbesondere gehalten sind, Ihre E-Mail-Spamfilter zu überprüfen und erforderlichenfalls Anpassungen vorzunehmen, sodass von Chefslist versendete E-Mails nicht von Spamfiltern blockiert werden.

Chefslist ist technischer Anbieter der App und nicht Partei des Kaufvertrages.

‍

Der Lieferant teilt dem Abnehmer mit der Rechnung das Gutschriftskonto (IBAN) mit. Die Zahlung des Kaufpreises durch den Abnehmer hat zu Gunsten des Gutschriftskontos zu erfolgen.
